K-NEXUS is a community hub that welcomes people of all ages, including children, vulnerable adults, and neurodivergent individuals. To protect everyone โ€” especially minors and those at risk โ€” we operate comprehensive monitoring systems both within the physical hub and across all digital services including Nexus Flow, chat rooms, and the website.

These measures exist to:

  • Protect children and young people from predatory behaviour, grooming, and exploitation
  • Safeguard vulnerable adults using our services
  • Deter and detect anti-social behaviour, theft, and threats of violence
  • Comply with Scottish child protection legislation and UK safeguarding requirements
  • Provide evidence to Police Scotland if a criminal incident occurs
  • Enable our AI guardian (N.O.V.A.) to flag behavioural anomalies in real time

  • RFID Wristband Scanning โ€” Your wristband is scanned at entry/exit and at room checkpoints. This tells us who is in the building, in which room, and when they left. Required for fire safety and child protection.
  • CCTV Recording โ€” All communal areas inside K-NEXUS are covered by CCTV. Footage is stored securely and only reviewed in the event of an incident or safeguarding concern.
  • N.O.V.A. AI Monitoring โ€” Our AI guardian monitors Nexus Flow posts, chat rooms, and digital interactions in real time. It flags suspicious patterns, inappropriate content, and potential grooming behaviour to human safeguarding officers.
  • Website & Chat Activity โ€” All messages, posts, and interactions on the K-NEXUS platform are logged and moderated. Private messages do not exist โ€” all communication can be reviewed by staff for safeguarding purposes.
  • Age-Gated Access โ€” Your verified age determines which rooms, content, and facilities you can access. Attempting to bypass age restrictions results in immediate suspension.

By registering, you acknowledge and agree to the following:

  • Your RFID wristband must be worn at all times inside the hub. Removed wristbands trigger an automatic alert.
  • CCTV is in operation in all communal areas. There is no expectation of privacy in shared spaces.
  • All digital communications on K-NEXUS are monitored by N.O.V.A. and human moderators.
  • Abusive, predatory, or illegal behaviour results in permanent ban and referral to Police Scotland.
  • Under-16 members must have a linked parent/guardian account. Unaccompanied minors under 12 are not permitted.
  • K-NEXUS staff and N.O.V.A. can restrict or suspend access at any time for safeguarding reasons.
  • Data is processed under GDPR Article 6(1)(e) & (f) โ€” public task and legitimate interest in safeguarding.
  • You can request your data at any time, but safeguarding records are retained as required by law.

1. Membership & Registration

All visitors must register with their real name, date of birth, address, email, and a recognisable photo. False information โ€” particularly regarding age โ€” is grounds for immediate and permanent exclusion, and may be reported to Police Scotland under child protection obligations.

2. RFID Wristband Policy

Every member is issued an RFID-enabled wristband at their first in-person visit. The wristband must be worn at all times inside K-NEXUS. It is scanned at entry and exit points, and at room checkpoints. This data is used for fire safety compliance, occupancy monitoring, and safeguarding of minors and vulnerable adults. Deliberately removing, swapping, or tampering with wristbands is a bannable offence.

Legal Basis for RFID Tracking: RFID wristband scanning within K-NEXUS premises constitutes location monitoring within a contained physical environment (not general geolocation tracking). This processing is carried out under:

  • UK GDPR Article 6(1)(e) โ€” processing necessary for a task carried out in the public interest (community safeguarding, as a registered CIC);
  • UK GDPR Article 6(1)(f) โ€” legitimate interest in the physical safety of all members, particularly children and vulnerable adults;
  • Children (Scotland) Act 1995, s.5 โ€” duty of care towards children in our premises;
  • Fire (Scotland) Act 2005 โ€” legal duty to maintain accurate occupancy records;
  • ICO Children's Code, Standard 10 (Geolocation) โ€” RFID within a contained venue for fire safety and child protection constitutes a compelling reason for location monitoring to be active by default, in the best interests of the child.

RFID data is not shared externally except with Police Scotland or Scottish Fire and Rescue Service in the event of an emergency or criminal investigation. A Data Protection Impact Assessment (DPIA) has been completed for this processing.

3. CCTV & Physical Monitoring

CCTV operates 24/7 in all communal areas of K-NEXUS. There is no CCTV in toilets or private consultation rooms. Footage is retained for 30 days and may be retained longer if related to an incident. Footage may be shared with Police Scotland or social services when required by law.

Legal Basis for CCTV: CCTV monitoring is carried out under UK GDPR Article 6(1)(e) and 6(1)(f), the Protection of Freedoms Act 2012 (Surveillance Camera Code of Practice), and the Regulation of Investigatory Powers (Scotland) Act 2000. Signage is displayed at all entry points in compliance with ICO CCTV guidance. Children are recorded only in communal/supervised areas and footage involving children receives enhanced protection under UK GDPR Article 8 and Recital 38.

4. N.O.V.A. AI Monitoring & Digital Safety

N.O.V.A. (Naturally Optimised Virtual Assistant) monitors all digital activity on K-NEXUS platforms including Nexus Flow posts, direct messages, chat rooms, and website interactions. There are no private messages โ€” all communications can be reviewed by safeguarding staff. N.O.V.A. uses pattern recognition to flag potential grooming, bullying, exploitation, and illegal activity in real time.

Legal Basis for AI Monitoring: N.O.V.A.'s monitoring of children's digital activity falls within the ICO Children's Code, Standard 12 (Profiling) safeguarding exemption: "if you are profiling in order to meet a legal or regulatory requirement (such as a safeguarding or child protection requirement)" โ€” profiling for this purpose need not be subject to a privacy setting or switched off by default. N.O.V.A. flags are reviewed by human safeguarding officers in compliance with UK GDPR Article 22 (right to human intervention). N.O.V.A. does not make automated decisions that produce legal effects on children โ€” all safeguarding decisions are made by trained human staff. A DPIA has been completed for this processing as required by the ICO when profiling children's data.

5. Age-Gated Access

Access to rooms, content, and digital features is determined by your verified age. Under-16 members have restricted access and require a linked parent/guardian account. Under-12 members must be accompanied by a registered adult at all times. Attempting to access age-restricted areas or content results in immediate suspension.

6. Child Protection

K-NEXUS operates under the following child protection legislation:

  • Children (Scotland) Act 1995 โ€” duty to safeguard and promote the welfare of children;
  • Protection of Children (Scotland) Act 2003 โ€” obligations regarding persons who pose a risk to children;
  • Protection of Vulnerable Groups (Scotland) Act 2007 โ€” PVG scheme membership required for all staff and regular volunteers working with children or protected adults;
  • Children and Young People (Scotland) Act 2014 โ€” wellbeing indicators (SHANARRI);
  • National Guidance for Child Protection in Scotland 2021 (updated 2023) โ€” inter-agency child protection procedures;
  • UK GDPR Article 8 & Recital 38 โ€” enhanced data protection for children.

Any suspicion of harm, abuse, grooming, or exploitation is reported immediately to Police Scotland and/or social work services in accordance with inter-agency child protection procedures. All staff and regular volunteers hold current PVG Scheme membership through Disclosure Scotland. N.O.V.A. maintains a real-time safeguarding log which is available to designated Child Protection Officers.

6A. Parental & Guardian Responsibility

K-NEXUS is not a childcare facility and is not a substitute for parental or guardian supervision. While we implement extensive monitoring systems (RFID, CCTV, N.O.V.A. AI, staff patrols), parents and guardians retain primary legal responsibility for their children at all times. Under-12 members must be accompanied by a registered adult. Under-16 members must have a linked parent/guardian account. By registering your child, you acknowledge that:

  • You have read and understood all safeguarding measures K-NEXUS employs;
  • You accept that no monitoring system โ€” human, electronic, or AI โ€” is infallible or can guarantee the absolute safety of any person at all times;
  • You retain parental/guardian duty of care for your child while they are on K-NEXUS premises;
  • K-NEXUS staff and N.O.V.A. assist in safeguarding but do not replace your responsibility as parent or guardian;
  • In the event that a criminal act is committed against your child by a third party despite the monitoring measures in place, liability rests with the perpetrator of that criminal act, not with K-NEXUS Dundee CIC, its staff, or its monitoring systems.

6B. Safeguarding Systems โ€” Best Efforts, Not Guarantees

K-NEXUS Dundee CIC deploys RFID wristband tracking, CCTV, N.O.V.A. AI monitoring, PVG-checked staff, and age-gated access as part of a comprehensive, multi-layered safeguarding approach. These systems represent our best efforts to protect all members, particularly children and vulnerable adults. However, you acknowledge and accept that:

  • No technology โ€” including AI, RFID, or CCTV โ€” is 100% reliable. Systems may experience temporary outages, delays, blind spots, or failures;
  • N.O.V.A. is an artificial intelligence system that uses pattern recognition. It may produce false positives or fail to detect every threat. It is a tool that supports human decision-making, not a replacement for it;
  • Staff cannot physically observe every person in every room at every moment;
  • K-NEXUS cannot prevent all criminal acts. If a person with criminal intent enters the building and commits an offence despite all monitoring systems being operational, the criminal liability rests solely with the offender;
  • K-NEXUS Dundee CIC shall not be held liable for any incident, injury, abduction, assault, or harm that occurs despite the reasonable safeguarding measures described in these terms being in place and operational.

K-NEXUS commits to maintaining, testing, and improving all safeguarding systems. Any system failure will be logged, investigated, and rectified as a matter of urgency.

7. Conduct & Bans

Abusive, threatening, discriminatory, or predatory behaviour results in permanent exclusion. K-NEXUS reserves the right to suspend or ban any member at any time for safeguarding reasons. Banned individuals are reported to Police Scotland where criminal conduct is suspected.

8. Data Protection (GDPR)

Personal data is processed under UK GDPR Article 6(1)(e) (public task) and 6(1)(f) (legitimate interest in safeguarding). Children's data receives enhanced protection under Article 8 and Recital 38. You may request access to your data at any time (Subject Access Request under Article 15). However, safeguarding records are retained in accordance with Scottish law and may not be deleted on request where retention is necessary for child protection purposes (Article 17(3)(d) โ€” archiving in the public interest).

DPIA: K-NEXUS has completed Data Protection Impact Assessments for: (a) RFID wristband tracking of all members including children; (b) CCTV monitoring in communal areas; (c) N.O.V.A. AI behavioural monitoring and content moderation; (d) processing of children's registration data including photographs. These DPIAs are reviewed annually or when processing changes materially. The DPIAs are available for inspection by the ICO upon request.

ICO Registration: K-NEXUS Dundee CIC is registered with the Information Commissioner's Office as a data controller.

9. Assumption of Risk

By registering and entering K-NEXUS premises, you acknowledge that participation in activities including but not limited to VR experiences, gaming, physical activities, communal dining, and use of shared equipment carries inherent risk. You voluntarily assume all such risks.

Personal belongings brought onto K-NEXUS premises are your sole responsibility. K-NEXUS Dundee CIC accepts no liability for lost, stolen, or damaged personal property.

10. Limitation of Liability

10.1 K-NEXUS Dundee CIC (SC881084), its directors, staff, volunteers, governing body members, and any partner organisations (including but not limited to NHS Tayside, Dundee City Council, and Police Scotland liaison officers) shall not be held liable for any loss, injury, damage, or claim arising from:

  • Your use of K-NEXUS facilities, equipment, VR systems, or digital services;
  • Interactions between members within the hub or on K-NEXUS digital platforms;
  • Any incident that occurs despite the monitoring and safeguarding measures described herein;
  • Temporary failure, downtime, or technical limitation of RFID, CCTV, or N.O.V.A. monitoring systems, provided K-NEXUS has taken reasonable steps to maintain and operate those systems;
  • Criminal acts committed by third parties on or near K-NEXUS premises, including but not limited to abduction, assault, theft, grooming, or exploitation, where K-NEXUS's safeguarding systems were operational and reasonable measures were in place;
  • Actions taken by other members, visitors, or third parties on or off premises;
  • Any harm, loss, or injury to a child or vulnerable adult where the parent, guardian, or carer failed to fulfil their own duty of supervision as outlined in Section 6A;
  • Loss of data, service interruption, or digital platform outages.

10.2 Nothing in these terms excludes or limits liability for: (a) death or personal injury caused by the negligence of K-NEXUS, its staff, or agents; (b) fraud or fraudulent misrepresentation; (c) any breach of the obligations implied by section 2 of the Supply of Goods and Services Act 1982; or (d) any other liability that cannot be excluded or limited under the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015, the Occupiers' Liability (Scotland) Act 1960, or any other applicable Scottish or UK law.

10.3 K-NEXUS acknowledges its duty of care under the Occupiers' Liability (Scotland) Act 1960, the Children (Scotland) Act 1995, and the Health and Safety at Work etc. Act 1974. The limitations in Section 10.1 apply only to the extent that K-NEXUS has discharged its duty of care by implementing and maintaining the safeguarding measures described in these terms. If K-NEXUS is found to have been negligent in implementing or maintaining those measures, this limitation clause does not apply to that negligence.

10.4 Where liability cannot legally be excluded, K-NEXUS Dundee CIC's total aggregate liability to you shall not exceed the amount you have paid to K-NEXUS (if any) in the 12 months preceding the claim.

11. Indemnity

You agree to indemnify and hold harmless K-NEXUS Dundee CIC, its directors, staff, volunteers, and partner organisations from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your breach of these terms; (b) your conduct within the hub or on K-NEXUS digital platforms; (c) any false or misleading information provided during registration; or (d) any unlawful activity you engage in on K-NEXUS premises or platforms.

12. No Access Without Registration

Registration is mandatory for all visitors and members. No person may enter K-NEXUS premises, use any K-NEXUS digital service (including Nexus Flow, chat rooms, and the website), or participate in any K-NEXUS activity without completing this registration process in full, including all consent checkboxes. Refusal to consent to monitoring and safeguarding measures means you cannot register and cannot access K-NEXUS. This is non-negotiable for the protection of children and vulnerable adults.

13. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of Scotland. Any dispute arising from these terms or your use of K-NEXUS shall be subject to the exclusive jurisdiction of the Scottish courts.

14. Severability

If any provision of these terms is found by a court of competent jurisdiction to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

15. Changes to Terms

These terms may be updated periodically. Members will be notified of material changes via their registered email. Continued use of K-NEXUS services after notification constitutes acceptance of the updated terms. If you do not agree to updated terms, you must cease using K-NEXUS services and request account closure.
